We (Dualite Technology Pvt. Ltd., or "Dualite") are deeply concerned about your privacy and we take this concern very seriously. This Privacy Policy ("Privacy Policy") sets out how we collect, process, use and may disclose your data when you use our Figma plugin called Dualite ("Dualite Figma Plugin"). The Dualite Figma Plugin is referred to as the "Platform". References to "we", "our" or "us" or the "Company" shall mean the Platform and/or Dualite Technology Private Limited, which has its registered office at E-65 Shastri Nagar, Jodhpur. 

1.2

The Dualite Figma Plugin is a software application developed by an individual or entity, to extend the functionality and features of the Figma design and prototyping platform(“Figma Tool”), a software entity owned by Figma, Inc., headquartered at 760 Market Street, San Francisco. It operates within the Figma environment, interacting with Figma files, components, and design assets to enhance, automate, or augment various design and collaboration processes. The Dualite Figma Plugin is designed to facilitate tasks such as design workflow optimization, data import/export, collaboration enhancements, and other related functions within the Figma Tool. It is made available to Figma users through the Figma Plugins ecosystem, subject to Figma's terms of service, policies, and guidelines.

Please note that for the purposes of our Privacy Policy and our Terms, any references to "you", "your" or "user" shall mean any natural person aged 18 years or above who is competent/capable of contracting within the meaning of the Indian Contract Act, 1872 using our Platform. If you are a minor over the age of 13 years and under the age of 18 years, your parent or guardian must agree to our Terms and Privacy Policy on your behalf. Please ask your parent or guardian to read these Terms and Privacy Policy with you, since they constitute an agreement between your legal guardian or parent and us, and to the extent permissible under applicable laws, enforceable against you.  Any persons under the age of 18 years should seek the consent of their parents/legal guardians before providing any information about themselves and before accessing or using the Applications/Websites/Services.

We will not use or share your information with anyone except as described in this Privacy Policy.

This Privacy Policy is a part of and is to be read with the Dualite Terms of Use ("Terms"). By using this Platform, you agree to the terms and conditions of this Privacy Policy. You also consent to our use and disclosure of your Personal Information (as defined below) in the manner described in this Privacy Policy. The capitalized words used in this Privacy Policy but not defined herein shall have the meaning given to such words in the Terms. If you do not agree with the terms and conditions of this Privacy Policy, please do not use this Platform.

In all cases, you agree that that no separate act is required to make the Terms or the  Privacy Policy binding on you, and that your act of visiting/accessing/using any part of the Chatbot/Website/Services (with the consent of your parent/legal guardian if you are under 18 years) constitutes your full and final acceptance of this Privacy Policy and the Terms.

Please take a moment to familiarize yourself with our Privacy Policy. If you do not agree with any provisions of the Terms or this Privacy Policy, we advise you not to use or access the Platform.

While using Our Service, We may ask You to provide us with certain personally identifiable information that can be used to contact or identify You in an end-to-end encrypted manner. Personally identifiable information may include, but is not limited to:
- Figma user ID
- Figma ID associated other Metadata
- Email address
- Password
- Mobile Number
- First and Last name
- Usage Data

Usage Data: Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Technical data and information, such as your mobile carrier-related information, configuration information made available by your web browser or other programs you use to access the Platform, IP address, and device ID and the type and identification number, your log files, browser type and version, operating system used by the device, and any other information collected through cookies, web beacons, and other tracking technologies. We may also collect anonymous website analytics statistics (collectively “Technical Data”).

Customer Support Information: Any information that you provide to our customer support team regarding any assistance or support that you may require for using our Platform from time to time to help provide you support and assistance.

Information and data we collect automatically when you access our Platform:

Figma User Token Key: When the plugin is opened within Figma and the user logs in, Dualite will receive the user token key in a pseudonymous manner for access to their Figma files. Dualite will receive and securely store the key associated with the respective Figma user. This storage of file keys allows Dualite to establish the necessary connection and enable bi-directional linking between Figma and Dualite.

Device Data: "Device Data" includes without limitation, the following:

Device operations: Information about operations and behaviors performed on the device, such as whether a window is foregrounded or backgrounded.

Data from device settings: Information you allow us to receive through device settings you turn on, such as access to your location, or photos with your consent.

Network and connections: Information such as the name of your mobile operator or ISP, language, time zone, IP address and connection speed.

Cookies: Our Platform's analytics tool uses cookies to distinguish you from other users of our Platform. This helps us to provide you with a good user experience when you browse our Platform and also allows us to improve the Platform. We collect the cookie data from the cookies on your device. We may also receive Technical Data about you if you visit other websites employing our cookies.

A cookie, also called anonymous unique identifiers is a small data element that a website can send to your device. This data element will be stored on your hard drive or internal memory so that it can be recognised when you return. Like any other app or website, we use cookies. These cookies are used to store information including users’ preferences, and the pages on the app that the user accessed or visited. The information is used to optimise the users’ experience by customising our Platform’s content based on visitors’ browser type and/or other information.

We may also be working closely with third parties (including, for example, business partners, sub-contractors in technical domains, analytics providers, search information providers and other marketing-based agencies) and they may receive information about you from such sources. Such data may be shared internally and combined with data collected on an aggregate basis through this Platform for analytical and marketing purposes to ensure a better user experience on our Platform

How and why is the data used

We collect and store the information provided by you from time to time to ensure that we organise our Platform in a manner that is most suitable for you, with features and tools most likely to meet your need, and:

To improve our Platform — we continually strive to improve our site offerings based on the information and feedback we receive from you.

To improve customer service — your information helps us to more effectively respond to your customer service requests and support needs.

To send periodic emails — The email address you provide may be used to send you information, notifications that you request about changes to topics or in response to your user name, and respond to inquiries, and/or other requests or questions.

To facilitate communication and to notify you about changes to the Platform, including this Privacy Policy, Terms of Service and provision of user support;

To verify your identity so as to enforce our terms, conditions, and policies and any of our rights, or the rights of our affiliate companies, or other users of the Platform. The data collected by us helps us better understand how you use and access the Platform and to improve and deliver the optimal user experience on the Platform;

To develop new services and improve the existing services and the Platform and integrate user feedback and requests;

To administer the Platform and for internal operations and legal compliance, including troubleshooting, data analysis, testing, research, security, fraud-detection, account management, and survey purposes in accordance with applicable law and enforce our Terms of Service;

To pseudonymise and aggregate your information, including Personal Information, for conducting user demographic analysis on items such as region, phone model, operating system platform, system language, and the Platform version in order to better understand how our users are using Platform;

How do we share the collected information?

Please note that while none of your data is sold, it is shared with third parties on an aggregate and pseudonymised scale if we have permission or are required by law to do so. This data is shared for processing of information and ensuring your optimal experience with IDA

Government bodies or law enforcement agencies: if we have a good-faith belief that it is reasonably necessary to share your personal data specifically or information in order to comply with any legal obligation or any government request; or to protect the rights or prevent any harm to the property, or safety of our Company/Platform, our customers, or public; or to detect, prevent or otherwise address public safety, fraud, security or technical issues.


Special circumstances 

We may also disclose your information (including Personal Information) to select third parties in the following circumstances:If Dualite or substantially all of its assets are acquired by a third party, in which case personal data held by us about our users and customers will be one of the transferred assets. If we are involved in a merger, acquisition, bankruptcy, reorganization or sale of assets such that your information would be transferred or become subject to a different Privacy Policy, we will notify you in advance so you can opt out of any such new policy by deleting your account before transfer.

Data Retention

We’ll hold on to your information for as long as you have a Dualite account, or for as long as is needed to be able to provide the services to you, or in the case of any contact you may have with our Customer Care team, for as long as is necessary to provide this necessary support. 

Where we process personal data for our Affiliates and other purposes as written out above or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data so that we can respect your request in future. 

For any content where we entertain your request for deletion, there is a possibility that copies of any public content (and not automatically collected information) will be retained indefinitely in our systems, including in cached and archived systems and pages of the Platform, or if other users have copied or saved that information. In addition, due to the nature of the Internet, copies of your content, including content that you have removed or deleted from your account, may also exist elsewhere on the Internet and be retained indefinitely.

We do not retain your personal data or Sensitive Personal Information (defined below in this paragraph) for longer than is required for the purposes for which the information may be lawfully used. "Sensitive Personal Information" shall mean passwords and any other information that is classified as sensitive under Section 3 of the Rules.

If reasonably necessary or required to meet legal or regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our terms and conditions, we may also keep hold of some of your information as required, even after you have closed your account or it is no longer needed to provide the services to you.

Dualite may periodically update this Privacy Policy. All amendments will be reflected in an updated version of this Privacy Policy on our website. Whenever we make any changes to this Privacy Policy that are important for you to know about, we will post the updated Privacy Policy here and will email you as well.Your continued use of our website after any modification to this Privacy Policy shall constitute your acceptance of the amended Privacy Policy. Please take the time to periodically review this Policy for the latest information on our privacy practices.

We may from time to time send you service-related announcements when we consider it necessary to do so (such as when we temporarily suspend the Platform for maintenance, or security, privacy, or administrative-related communications). We send these to you via SMS and/or email and/or WhatsApp. It is essential for us to provide you with these service-related announcements, which are not promotional in nature and are used solely to protect your account and keep you informed of important changes to the Platform.
